William E. McCarthy,
associate attorney, has extensive experience and
knowledge dealing with comprehensive estate planning
matters, simple and complex
probate
and trust administration issues, estate tax issues, and
business
planning issues, such as business
formation, operation, management, mergers and
dissolution. He frequently also handles a wide
variety of
real
estate proceedings,
commercial transactions and a broad range of taxation issues.
He also practices in the areas of
administrative
law,
contract
law, estate
mediation, and
partnership and related tax issues. His unique sense of humor
coupled with his approachable demeanor contribute to
his proficiency and his ability to connect with and
effectively advocate for and counsel his clients.
He initially joined the firm as an intern while
attending law school. Upon graduating from The
University of Montana School of Law in May of 2002,
passing the Montana State Bar Exam and being
admitted to practice law in Montana, he became an
associate attorney in October of 2002. He received
an Associate of Arts degree from Montana Tech
(1995), a Bachelor of Arts in History from The
University of Montana (1997), and a Juris Doctorate
degree from The University of Montana School of Law
(2002). When admitted to law school he was also
working towards attaining a Masters in Business
Administration.
He is a member of many professional organizations
including the Montana Bar Association, Western
Montana Bar Association, American Bar Association,
Western Montana Low Income Taxpayer Clinic, the
National Academy of Elder Law Attorneys and the
Business, Estates, Trust, Tax and Real Estate (BETTR)
Section of the Montana Bar Association. He is
admitted to practice law in all Montana State and
Federal Courts and the United States Tax Court. He
serves as legal counsel to numerous Montana
for-profit and non-profit organizations and is a
member of the Board of Directors of Children's
Oncology Foundation, Inc., which operates Camp Mak-a-Dream.
He is also a member of several community
organizations, including the Knights of Columbus, St
Anthony's Parish and Leadership Missoula. He has
extensive background in working with the Montana
Legislature and, along with firm member Pat
Dougherty, is currently in the process of developing
legislation to assist Montana Courts and litigants
better manage adversarial probate proceedings.
He is very proud of his Irish-American heritage and
also of the fact that he was born and raised in
Butte, Montana as a 4th generation Montanan. He has
three siblings, two of which are high school
teachers and one who is a police captain. His father
is currently the Butte-Silver Bow County Attorney.
He has a sizeable extended family located across the
United States and even Ireland. His wife is
originally from the small farming and ranching
community of Valier, Montana. She holds a Doctorate
in Pharmacy from The University of Montana School of
Pharmacy and is employed at a locally owned Missoula
pharmacy. Together they are the proud parents of two
fittingly assertive and rebellious Irish sons and a
fearless eight pound Shi Tzu.
When not changing diapers, he enjoys the Montana
outdoors, watching sporting events, traveling, and
spending as much time as possible with his family
and friends. He especially enjoys football and is
also an ardent fan of the Montana Grizzlies and the
Miami Dolphins. Consequently, he is usually in
better humor on Saturday than on Sunday.
He prefers to be referred to as Willie or Will.
